The Freelancer and Consultant Tax Guide

If you send invoices yourself, there is no Form 16. You work out profit under Section 44ADA, watch TDS cut by Indian clients, and pay advance tax yourself. The rupee limits below follow the Income-tax Act, 2025 and the CBDT page on presumptive tax for small businesses and professions. This page is about fees earned in FY 2026-27. That year and the AY 2026-27 label on some CBDT tables are not the same year.

What Section 44ADA does

Section 44ADA lets a notified professional skip a full set of books. You do not list every laptop bill, software subscription, or train ticket. You declare profit as a fixed share of what clients paid you.

Deemed profit
50%

of gross receipts is the profit you pay tax on

Say clients paid you ₹10 lakh. Taxable profit is ₹5 lakh. The other ₹5 lakh is treated as your costs: internet, a laptop, travel, software, and the rest. The tax department accepts that split without asking for those bills, as long as you stay inside the section.

Higher limit if you are paid digitally

The usual receipt cap is ₹50 lakh. If cash is under 5% of receipts, the cap is ₹75 lakh. Bank transfer, UPI, and card payments count as digital. See the CBDT presumptive page.

This is a section of the Income-tax Act, written for small professional practices. It is not a side route around the Act.

44AD or 44ADA

The names look alike. They cover different work. Using the wrong one is one of the things that can start an audit.

Applies to A business A profession or consultancy
Deemed profit 8% of cash receipts, 6% of digital receipts 50%
Usual cap ₹2 crore turnover ₹50 lakh receipts
Cap if digital is at least 95% ₹3 crore ₹75 lakh
Advance tax One payment, by 15 March One payment, by 15 March

Which section to open

You are billing for your own skill (consulting, design, coding, writing, legal work, medicine): read Section 44ADA, then check the profession list below. You run a business with stock or staff: read Section 44AD.

03

Who can use it

44ADA is only for professions on a closed list under section 44AA(1), plus the professions CBDT has notified. You cannot opt in because the work feels professional.

On the 44ADA list

  • ✓ Legal professionals
  • ✓ Medical professionals
  • ✓ Engineers and architects
  • ✓ Accountants and chartered accountants
  • ✓ Technical consultants
  • ✓ Interior decorators
  • ✓ IT professionals, under the specific CBDT notification

Often outside 44ADA

  • ✗ Generic content creators
  • ✗ Gig work such as delivery or rides
  • ✗ Traders and resellers
  • ✗ Anyone with employees

44ADA also stops in three cases:

  1. Gross receipts cross ₹50 lakh, or ₹75 lakh when cash is under 5%.
  2. You declare profit below 50%. The 50% presumption then does not apply at all.
  3. One client pays you like an employee. That receipt can be treated as salary.

Content creators

A content creator or influencer who is not in a notified profession may not use 44ADA. The fallback is Section 44AD, if the activity is a business that section covers, or ITR-3 with regular books. 44ADA covers the section 44AA(1) professions (legal, medical, engineering or architecture, accountancy, technical consultancy, interior decoration) and CBDT-notified work such as film artists, authorised representatives, company secretaries, and IT professionals.

04

No standard deduction

✗ ₹75,000 standard deduction

The ₹75,000 standard deduction is for salary and pension under Section 16. It is not a deduction from professional receipts. Under 44ADA you already take 50% of receipts off as deemed costs. The employee benefits page is the CBDT note for that salary deduction. The salaried guide is here.

Claiming the standard deduction on top of 44ADA is not allowed. If the return does it, a notice is a real possibility. The same bar applies to Section 44AD. The standard deduction belongs only to the salary head.

05

Old regime or new regime

You still pick a regime. For a freelancer the large cut is the 50% under 44ADA, which both regimes allow. Chapter VI-A deductions such as 80C are the part that changes.

Feature New regime Old regime
44ADA 50% of receipts 50% of receipts
Standard deduction Not allowed Not allowed
80C, up to ₹1.5 lakh Not available Available
80D, health insurance Not available Available
80CCD(1B), NPS ₹50,000 Not available Available
87A rebate limit ₹12 lakh ₹5 lakh

Why many freelancers land on the new regime

If the 50% deemed profit is ₹12 lakh or less, the new-regime Section 87A rebate can bring the tax to ₹0. You do not need 80C proofs for that result. Receipts of ₹24 lakh produce a ₹12 lakh deemed profit, which is the top of that rebate band. The resident-benefits note is on the CBDT 87A page. The new regime itself is Section 115BAC.

06

Example: ₹18 lakh in consulting fees

Fees for the year are ₹18,00,000, from US and Indian clients. Cash is under 5%, so the ₹75 lakh digital cap is the one that applies. ₹18 lakh is inside it.

Step 1. Apply 44ADA

50% deemed profit is ₹9,00,000. The other ₹9 lakh is treated as business cost.

New regime Lower tax
Gross receipts₹18,00,000
44ADA deemed profit (50%)₹9,00,000
Taxable income₹9,00,000
Tax after 87A (income at or under ₹12 lakh)₹0
Old regime
Gross receipts₹18,00,000
44ADA deemed profit (50%)₹9,00,000
80C (PPF, LIC, and similar)−₹1,50,000
80D (health insurance)−₹25,000
80CCD(1B) NPS−₹50,000
80TTA (savings interest)−₹10,000
Taxable income₹6,65,000
Tax plus 4% cess₹47,320

On these numbers the new regime is lower by

₹47,320

Tax is ₹0 in the new regime and ₹47,320 in the old regime. The new-regime result does not need investment proofs.

Old-regime arithmetic: ₹9,00,000 minus ₹2,35,000 of deductions is ₹6,65,000. That is above the old-regime ₹5 lakh rebate line, so 87A does not wipe the tax. Slab tax is ₹12,500 on the band from ₹2.5 lakh to ₹5 lakh, plus ₹33,000 on ₹1.65 lakh at 20%, which is ₹45,500. Cess at 4% is ₹1,820. Total ₹47,320.

07

TDS under Section 194J

An Indian client who pays you more than ₹50,000 in the year has to deduct 10% TDS on professional fees under Section 194J. A foreign client who is not required to deduct Indian TDS will not do this. More on withholding is in the TDS guide.

TDS is tax already paid

It is not a second tax on top of your return. It is a credit. In the ₹18 lakh example the new-regime tax is ₹0, so the 10% the client withheld comes back as a refund after you file. Check the credit on Form 26AS and the AIS before you file.

The Union Budget 2025 raised the 194J threshold from ₹30,000 to ₹50,000. A client who pays you ₹40,000 in the year no longer has to deduct under that higher line.

If PAN and Aadhaar are not linked, the client has to deduct 20% instead of 10%. You still claim it in the return, but twice as much cash sits with the department until then. Linking steps are on the official Aadhaar link page. The longer note is the PAN–Aadhaar guide.

Payment TDS rate When it starts
Professional or technical fees 10% ₹50,000 in the year
Technical services that are not consulting 2% ₹50,000 in the year
PAN missing, invalid, or not linked 20% No threshold
08

Advance tax by 15 March

A salary gets tax cut every month. Professional fees do not, unless the client deducts TDS. If you use 44ADA or 44AD, you do not spread the rest across four dates. You pay the whole estimated tax in one instalment.

44ADA and 44AD
15 March

One payment of the full estimated tax. Dates for the year are on the tax calendar.

If you are outside 44ADA and 44AD, for example because you file ITR-3 from regular books, the quarterly shares are:

Due date Cumulative share What it covers
15 June 15% First quarter
15 September 45% Up to the second quarter
15 December 75% Up to the third quarter
15 March 100% Balance of the year. This is also the only date for 44ADA.

Sections 234B and 234C

Short or late advance tax draws interest at 1% a month. Section 234B is the shortfall against the tax due. Section 234C is the shortfall against an instalment. It is interest, calculated on the gap, not a flat fine.

09

GST and income tax

A GST registration does not change how 44ADA works. The two taxes use different laws, and the turnover you report should still be the same number in both places.

Question GST Income tax
When it starts ₹20 lakh of services From the first rupee of taxable income
What is taxed Value added at each stage Income for the year
How often you file Monthly or quarterly Once a year
Shared rule Receipts in the GST returns and receipts in the income-tax return should match
10

When you cross the limit

44ADA drops away if receipts cross ₹50 lakh (₹75 lakh when cash is under 5%), or if your real profit is under 50% and you want to declare that lower figure.

Over the cap

Receipts above ₹50 lakh, or above ₹75 lakh on the digital rule

Profit under 50%

You want to claim actual expenses instead of the flat half

Looks like salary

One client pays you the way an employer would

Once you are outside the section, three things follow:

  1. Keep full books of account.
  2. Get a tax audit under Section 44AB.
  3. File ITR-3 instead of ITR-4.
11

Filing ITR-4

While you stay on 44ADA, the return is ITR-4 (Sugam). It is the short form for presumptive income. ITR-3 is the long form, used once you keep books. Form downloads are on the CBDT returns page. Filing steps and dates are in the ITR guide.

Feature ITR-4 (Sugam) ITR-3
Who can use it People on 44AD, 44ADA, or 44AE Anyone with business or professional income
Total income limit ₹50 lakh or below No limit on the form
Books Not required Required
How long it takes Short form Long form

For a case that does not need an audit, the filing date in this guide is 31 July 2027. A 44ADA return that stays inside the section is a non-audit case, so that is the date.

This page is general information for FY 2026-27. It is not advice for your return. Check the CBDT pages linked above, and a chartered accountant if the receipts, the profession, or the regime choice are close to a line.
